1. ACEPTACION DE TERMINOS

Bienvenido a Platee. Estos Terminos de Servicio ("Terminos") constituyen un contrato legalmente vinculante entre usted ("usted", "usuario") y Platee ("nosotros", "nuestro", "nos") que rige su acceso y uso de la aplicacion movil Platee (la "App", "Servicio").

Al descargar, instalar, acceder o usar la App de cualquier manera, usted reconoce que ha leido, comprendido y acepta estar sujeto a estos Terminos y a todas las leyes y regulaciones aplicables. Si no esta de acuerdo con alguna parte de estos Terminos, debe dejar de usar la App inmediatamente y desinstalarla de su dispositivo.

Platee es desarrollado y operado por OneMemory SpA, una sociedad constituida en Santiago, Chile.

2. DESCRIPCION DEL SERVICIO

Platee es una herramienta de preservacion de recetas familiares disenada para ayudarle a:

Capturar y preservar recetas familiares mediante voz, texto o foto
Formatear recetas automaticamente con inteligencia artificial a partir de grabaciones de voz
Presentar recetas en un formato hermoso tipo libro
Colaborar en familia para compartir colecciones de recetas
Documentar platos y pasos de cocina con fotos
Cocinar con modo manos libres

Platee es una herramienta de preservacion de recetas unicamente. No brindamos asesoramiento nutricional, medico ni dietetico.

3. ELEGIBILIDAD Y REQUISITOS

Edad minima: Debe tener al menos 13 anos de edad para crear una cuenta y usar Platee. Si tiene entre 13 y 18 anos, debe contar con el consentimiento de un padre o tutor legal.

Informacion precisa: Usted acepta proporcionar informacion precisa, actual y completa durante el proceso de registro, y mantener dicha informacion actualizada.

Capacidad legal: Usted declara y garantiza que tiene la capacidad legal para celebrar este acuerdo vinculante.

4. CUENTAS DE USUARIO

Para usar Platee, debe crear una cuenta. Usted es responsable de:

Mantener la confidencialidad de su cuenta y contrasena
Todas las actividades que ocurran bajo su cuenta
Proporcionar informacion precisa y completa
Notificarnos inmediatamente de cualquier uso no autorizado

Su cuenta es personal. No puede compartir credenciales ni permitir que otros accedan a su cuenta.

5. LICENCIA DE USO

Le otorgamos una licencia limitada, no exclusiva, intransferible y revocable para descargar, instalar y usar la App en su dispositivo movil personal, unicamente para fines personales y no comerciales. Esta licencia no le otorga derechos de propiedad sobre la App.

5.1 Restricciones de uso

Usted acepta no:

Usar el servicio para cualquier proposito ilegal
Intentar obtener acceso no autorizado a nuestros sistemas
Interferir con o interrumpir el servicio
Cargar codigo malicioso o contenido danino
Hacerse pasar por otra persona o entidad
Usar sistemas automatizados para acceder al servicio
Copiar, modificar, descompilar o realizar ingenieria inversa de la App
Redistribuir, sublicenciar o vender la App a terceros

6. CONTENIDO DEL USUARIO

Usted conserva la propiedad de los datos que ingresa en Platee, incluyendo recetas, grabaciones de voz transcritas, fotos de cocina, recuerdos familiares, colecciones de recetas y cualquier otro contenido generado por el usuario.

Al usar nuestro servicio, nos otorga una licencia para almacenar, procesar y mostrar su contenido segun sea necesario para proporcionar el servicio. Esta licencia existe solo mientras mantenga su contenido en la App.

Nunca venderemos su contenido personal a terceros ni lo usaremos para fines no relacionados con la provision del servicio.

7. SUSCRIPCIONES Y PAGOS

Platee ofrece planes de suscripcion que desbloquean funciones adicionales. Las suscripciones se gestionan a traves de Apple App Store y RevenueCat.

Las suscripciones se renuevan automaticamente a menos que se cancelen al menos 24 horas antes del final del periodo actual
El pago se carga a su cuenta de Apple ID al confirmar la compra
Puede gestionar y cancelar suscripciones desde la configuracion de su cuenta de Apple ID
Los reembolsos se rigen por las politicas de Apple App Store

8. PROPIEDAD INTELECTUAL

La App Platee, incluyendo su diseno, funciones, codigo, graficos, interfaz de usuario, logotipos, sonidos y contenido, es propiedad de OneMemory SpA o nuestros licenciantes y esta protegida por leyes de propiedad intelectual de Chile y tratados internacionales. No puede copiar, modificar, distribuir ni crear obras derivadas sin nuestro permiso.

9. PRIVACIDAD

Su privacidad es importante para nosotros. Consulte nuestra Politica de Privacidad para comprender como recopilamos, usamos y protegemos su informacion. Al usar la App, usted consiente nuestra recopilacion y uso de informacion segun se describe en la Politica de Privacidad.

10. SERVICIOS DE TERCEROS

La App se integra con varios servicios de terceros:

Google Firebase: Autenticacion, almacenamiento de datos, funciones en la nube, analiticas y monitoreo de errores
RevenueCat: Gestion de suscripciones y compras dentro de la app
Google Sign-In / Apple Sign-In: Servicios de autenticacion

Su uso de estos servicios esta sujeto a sus respectivos terminos y politicas de privacidad.

11. EXENCIONES DE RESPONSABILIDAD

EL SERVICIO SE PROPORCIONA "TAL CUAL" SIN GARANTIAS DE NINGUN TIPO. NO GARANTIZAMOS QUE:

El servicio sera ininterrumpido o libre de errores
Los defectos seran corregidos
El servicio este libre de virus o componentes daninos

PLATEE ES UNA HERRAMIENTA DE PRESERVACION DE RECETAS UNICAMENTE. NO BRINDAMOS ASESORAMIENTO NUTRICIONAL, MEDICO NI DIETETICO. SIEMPRE CONSULTE CON PROFESIONALES CALIFICADOS RESPECTO A SU SALUD O NECESIDADES ALIMENTARIAS.

AUNQUE HACEMOS ESFUERZOS COMERCIALMENTE RAZONABLES PARA GARANTIZAR LA INTEGRIDAD DE LOS DATOS, NO GARANTIZAMOS QUE SUS DATOS SIEMPRE SERAN RESPALDADOS, PRESERVADOS O RECUPERABLES. USTED ES RESPONSABLE DE MANTENER SUS PROPIAS COPIAS DE SEGURIDAD DE INFORMACION CRITICA.

12. LIMITACION DE RESPONSABILIDAD

EN LA MEDIDA MAXIMA PERMITIDA POR LA LEY, NO SEREMOS RESPONSABLES POR DANOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES O PUNITIVOS, INCLUYENDO PERDIDA DE GANANCIAS, DATOS O FONDO DE COMERCIO.

NUESTRA RESPONSABILIDAD TOTAL NO EXCEDERA EL MAYOR ENTRE (A) EL MONTO TOTAL QUE USTED NOS HA PAGADO EN LOS 12 MESES ANTERIORES AL EVENTO, O (B) CIEN DOLARES (USD $100.00).

Algunas jurisdicciones no permiten la exclusion de ciertas garantias o la limitacion de responsabilidad. En tales jurisdicciones, nuestra responsabilidad se limitara en la mayor medida permitida por la ley.

13. INDEMNIZACION

Usted acepta indemnizar y mantener indemne a Platee, OneMemory SpA y sus directores, empleados y agentes de cualquier reclamacion, danos o gastos derivados de su uso del servicio o violacion de estos Terminos.

14. TERMINACION

Podemos suspender o terminar su cuenta en cualquier momento por cualquier razon, incluyendo la violacion de estos Terminos. Usted puede eliminar su cuenta en cualquier momento a traves de la configuracion de la App.

Al terminar:

Su derecho a usar el servicio cesara inmediatamente
Sus datos se eliminaran de acuerdo con nuestra Politica de Privacidad

15. CAMBIOS A LOS TERMINOS

Nos reservamos el derecho de modificar estos Terminos en cualquier momento. Le notificaremos de cambios significativos mediante un aviso en la App o un correo electronico. Su uso continuado del servicio despues de los cambios constituye la aceptacion de los nuevos Terminos.

16. LEY APLICABLE Y RESOLUCION DE DISPUTAS

Estos Terminos se regiran e interpretaran de acuerdo con las leyes de Chile, sin considerar sus disposiciones sobre conflictos de leyes.

Antes de presentar cualquier disputa formal, usted acepta contactarnos primero e intentar resolver la disputa de manera informal. Si la disputa no se resuelve dentro de sesenta (60) dias, cualquiera de las partes puede iniciar un procedimiento formal.

17. DISPOSICIONES GENERALES

Acuerdo completo: Estos Terminos, junto con nuestra Politica de Privacidad, constituyen el acuerdo completo entre usted y Platee respecto al uso del servicio.

Divisibilidad: Si alguna disposicion de estos Terminos es declarada inaplicable, las disposiciones restantes continuaran en pleno vigor y efecto.

No renuncia: Nuestra falta de ejercicio de cualquier derecho no constituira una renuncia a dicho derecho.

Cesion: Usted no puede ceder estos Terminos sin nuestro consentimiento previo por escrito. Nosotros podemos ceder libremente estos Terminos a cualquier tercero.

19. ACEPTACION

Al usar Platee, usted reconoce que ha leido, comprendido y acepta estar sujeto a estos Terminos de Servicio.

Si no esta de acuerdo con estos Terminos, no use la App. Su uso continuado de la App tras la publicacion de cambios a estos Terminos constituye su aceptacion de dichos cambios.

1. ACCEPTANCE OF TERMS

Welcome to Platee. These Terms of Service ("Terms") constitute a legally binding contract between you ("you," "user") and Platee ("we," "our," "us") governing your access to and use of the Platee mobile application (the "App," "Service").

By downloading, installing, accessing, or using the App in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must immediately cease using the App and uninstall it from your device.

Platee is developed and operated by OneMemory SpA, a company incorporated in Santiago, Chile.

2. DESCRIPTION OF SERVICE

Platee is a family recipe preservation tool designed to help you:

Capture and preserve family recipes via voice, text, or photo
AI-powered recipe formatting from voice recordings
Beautiful book-like recipe presentation
Family collaboration for shared recipe collections
Photo documentation of dishes and cooking steps
Hands-free cooking mode

Platee is a recipe preservation tool only. We do not provide nutritional, medical, or dietary advice.

3. ELIGIBILITY AND REQUIREMENTS

Age Requirement: You must be at least 13 years of age to create an account and use Platee. If you are between 13 and 18, you must have parental or legal guardian consent.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep your information updated.

Legal Capacity: You represent and warrant that you have the legal capacity to enter into this binding agreement.

4. USER ACCOUNTS

To use Platee, you must create an account. You are responsible for:

Maintaining the confidentiality of your account and password
All activities that occur under your account
Providing accurate and complete information
Notifying us immediately of any unauthorized use

Your account is personal. You may not share credentials or allow others to access your account.

5. LICENSE TO USE

We grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App on your personal mobile device solely for your own personal, non-commercial purposes. This license does not grant you any ownership rights in the App.

5.1 Restrictions on Use

You agree not to:

Use the service for any illegal purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the service
Upload malicious code or harmful content
Impersonate another person or entity
Use automated systems to access the service
Copy, modify, decompile, or reverse engineer the App
Redistribute, sublicense, or sell the App to third parties

6. USER CONTENT

You retain ownership of the data you enter into Platee, including recipes, transcribed voice recordings, cooking photos, family memories, recipe collections, and any other user-generated content.

By using our service, you grant us a license to store, process, and display your content as necessary to provide the service. This license exists only for as long as you keep your content in the App.

We will never sell your personal content to third parties or use it for purposes unrelated to providing the service.

7. SUBSCRIPTIONS AND PAYMENTS

Platee offers subscription plans that unlock additional features. Subscriptions are managed through the Apple App Store and RevenueCat.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
Payment is charged to your Apple ID account at confirmation of purchase
You can manage and cancel subscriptions from your Apple ID account settings
Refunds are governed by Apple App Store policies

8. INTELLECTUAL PROPERTY

The Platee app, including its design, features, code, graphics, user interface, logos, sounds, and content, is owned by OneMemory SpA or our licensors and is protected by intellectual property laws of Chile and international treaties. You may not copy, modify, distribute, or create derivative works without our permission.

9. PRIVACY

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

10. THIRD-PARTY SERVICES

The App integrates with various third-party services:

Google Firebase: Authentication, data storage, cloud functions, analytics, and error tracking
RevenueCat: Subscription and in-app purchase management
Google Sign-In / Apple Sign-In: Authentication services

Your use of these services is subject to their respective terms and privacy policies.

11. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

The service will be uninterrupted or error-free
Defects will be corrected
The service is free of viruses or harmful components

PLATEE IS A RECIPE PRESERVATION TOOL ONLY. WE DO NOT PROVIDE NUTRITIONAL, MEDICAL, OR DIETARY ADVICE. ALWAYS SEEK THE ADVICE OF QUALIFIED PROFESSIONALS REGARDING YOUR HEALTH OR DIETARY NEEDS.

WHILE WE MAKE COMMERCIALLY REASONABLE EFFORTS TO ENSURE DATA INTEGRITY, WE DO NOT GUARANTEE THAT YOUR DATA WILL ALWAYS BE BACKED UP, PRESERVED, OR RECOVERABLE. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF CRITICAL INFORMATION.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE PAST 12 MONTHS, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Platee, OneMemory SpA, and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

14. TERMINATION

We may terminate or suspend your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the App settings.

Upon termination:

Your right to use the service will cease immediately
We may delete your data in accordance with our Privacy Policy

15. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice in the App or sending you an email. Your continued use of the service after changes constitutes acceptance of the new Terms.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Chile, without regard to its conflict of law provisions.

Before filing any formal dispute, you agree to first contact us and attempt to resolve the dispute informally. If the dispute is not resolved within sixty (60) days, either party may bring a formal proceeding.

17. GENERAL PROVISIONS

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Platee regarding your use of the service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver: Our failure to exercise any right shall not constitute a waiver of such right.

Assignment: You may not assign these Terms without our prior written consent. We may freely assign these Terms to any third party.

If you do not agree to these Terms, please do not use the App. Your continued use of the App following the posting of changes to these Terms will be deemed your acceptance of those changes.
